TERMS & CONDITIONS

1. Definitions

“Authorised Agent” means any travel agent or website not owned or operated by the Company but authorised by the Company to facilitate a Guest’s Booking.
“Booking” means the Guest’s or Guest’s agent’s agreement to enter into a Contract with the Company for a Tour, subject to these Booking Conditions.
“Booking Conditions” means these booking conditions together with any relevant information contained in the Company’s brochures, on its Website, or in other written material provided by the Company, which collectively form the express terms of the Contract.
“Company” means Remote Films Ltd, trading as “Lens Explorers Journeys” and “Lens Explorers”.
“Confirmation Invoice” means the invoice issued by the Company to the Guest or the Guest’s Authorised Agent confirming the details of the Booking.
“Contract” means the legally binding agreement between the Company and the Guest for the Tour, as set out in the Confirmation Invoice.
“Group Tour” means a group experience or tour with an itinerary organised by the Company.
“Guest” means each person, including Minors, named on the Confirmation Invoice or to whom a Booking is transferred.
“Lead Guest” means the first-named Guest on the Booking, who acts on behalf of all persons named on the Booking.
“Minor” means any person under the age of 18.
“Privacy Policy” means the Company’s privacy policy, available on its Website.
“Tour” means the travel services booked by the Guest to be provided by the Company under the Booking. For clarity, the Company does not arrange or sell flights.
“Unavoidable and Extraordinary Circumstances” has the meaning set out in clause 19 of these Booking Conditions.
“Website” means the web domain www.lensexplorersjourneys.com, including all related pages, documents, and links published by the Company.

2. Your Relationship with the Company

2.1 Your Contract is with Remote Films Ltd, trading as “Lens Explorers Journeys” and “Lens Explorers”, of 18 Gerard Road, Barnes, London, SW13 9RG, registered in England under company number 7071939 (“the Company”, “we”, “us”, or “our”). References to “you” and “your” in these Booking Conditions mean the Lead Guest and all persons named on the Booking (including anyone added or substituted at a later date).

2.2 These Booking Conditions, together with our Privacy Policy, the relevant information on our Website, and any other written information we bring to your attention before confirming your Booking, form the basis of your Contract with us. Please read them carefully before making your Booking.

2.3 By making a Booking, the Lead Guest agrees on behalf of all persons named on the Booking that they:
2.3.1 have read these Booking Conditions and have authority to agree to them on behalf of all Guests;
2.3.2 consent to our use of personal data in accordance with our Privacy Policy and are authorised to provide such data (including special categories such as medical or dietary information) for all Guests;
2.3.3 are over 18 years of age, resident in the United Kingdom, and, where relevant, of the appropriate age to purchase or participate in the services booked;
2.3.4 accept financial responsibility for all payments due under the Booking; and
2.3.5 agree to check all travel documentation issued and notify us immediately of any errors.

2.4 Your Booking constitutes a “package” under the Package Travel and Linked Travel Arrangements Regulations 2018 (“PTRs”).
This means you benefit from certain legal protections under the PTRs. Further information about key legal rights applicable to package holidays can be found at:https://www.legislation.gov.uk/uksi/2018/634/contents/made

3. Booking & Paying for Your Holiday

3.1 Our aim is to design the right holiday to suit your requirements. You can contact us at info@lensexplorersjourneys.com and we will tailor an itinerary for you and provide a price per person. To maintain our service standards and assist with training, we may monitor or record telephone or email communications with you.

3.2 To secure your Booking, we require a minimum deposit of 15% of the total Booking cost, unless a lower amount is stated in any promotional offer or confirmed by us in writing. Some Tours may require a higher deposit; this will be advised at the time of booking. If you book within 75 days of departure, full payment is required at the time of booking, unless stated otherwise in writing or within promotional material.

3.3 If a deposit has been paid, the remaining balance is due 75 days before departure. If payment is not received on time, we reserve the right to cancel your Booking and retain your deposit.

3.4 We accept payment by bank transfer, cheque, and most major credit and debit cards. Payments can be made in British Pounds (GBP), US Dollars (USD), or Euros (EUR).

3.5 All Tours are subject to availability at the time of booking. If we do not accept your booking request for any reason, any deposit paid will be refunded in full.

3.6 Some Group Tours may require a minimum number of participants for the Tour to operate. Where a minimum applies, it will be stated in the Tour description on our Website and confirmed at the time of booking.

3.7 On receipt of your deposit (or full payment, where applicable), we will confirm your Tour and issue a Confirmation Invoice. A Contract will come into existence between you and us on the date we issue that Confirmation Invoice. We are not obliged to issue a Confirmation Invoice if an error is identified in pricing (see clause 5 below).

3.8 Please check all details carefully upon receipt of your Confirmation Invoice and any other documents, as they set out the services we have agreed to provide. Notify us (or your Authorised Agent, if applicable) immediately if any details are incorrect. It may not be possible to make changes later. Ensure that all names appear exactly as shown in the relevant passports, including middle names.

3.9 If you book directly with us, all correspondence will be sent to the Lead Guest’s address unless you specify otherwise. If you provide a business address, we may also request a residential address for emergency and security purposes.

3.10 If you book through an Authorised Agent, all communications will be made via that Agent, who will act on your behalf in relation to your Booking.

3.11 All payments made to an Authorised Agent in connection with your Booking are held by that Agent on behalf of the Company until the funds are forwarded to us. The Company is not responsible for any failure by an Authorised Agent to pass on payments correctly, except where required by law.

4. Special Requests

4.1 If you have any special requests (for example dietary requirements, room preferences, or particular facilities), please indicate these in writing at the time of booking (“Special Request”).

4.2 We will pass your Special Request to relevant suppliers but cannot guarantee that it will be fulfilled. We recommend checking directly with your airline, hotel, or service provider once arrangements are confirmed, where relevant.

4.3 We will make every reasonable effort to accommodate Special Requests but cannot accept liability if a request cannot be met.

4.4 Any Special Request will only form part of your Contract if we confirm in writing that it will be guaranteed.

4.5 Most hotels allow check-in during the mid-afternoon. If you wish to guarantee early access to your room upon arrival, this can usually be arranged at an additional cost. Room upgrades may also be available on request, subject to availability and additional charges.

5. Pricing Policy

5.1 We may change the advertised price of any of our Tours from time to time, including those shown on our Website, in promotional materials, or via email correspondence. While price changes are rare, they can occur at short notice. The price confirmed to you at the time of booking is the price that will apply to your Tour.

5.2 We reserve the right to notify you of any price change before accepting your Booking. Occasionally, errors may occur in pricing.

  • If the actual price is lower than that shown when you book, we will charge the lower amount.

  • If the actual price is higher, we will contact you to confirm whether you wish to proceed or cancel your Booking.

5.3 If we accept and process your Booking where a pricing error is clear and could reasonably have been recognised by you as such, we may cancel your Booking and refund any sums paid.

5.4 After your Booking has been confirmed, we may increase the price of your Tour only to allow for changes that are a direct result of:
5.4.1 increases in the cost of transportation or fuel used for ground transfers or internal travel within your itinerary;
5.4.2 increases in taxes or fees imposed by third parties not directly involved in the delivery of your Tour (including local tourist taxes or entry fees to parks and reserves); and
5.4.3 fluctuations in the exchange rates relevant to your Tour.

5.5 If the cost of your Tour increases due to the above factors, we will notify you of the amount. If this increase is more than 8% of the total price of your confirmed Tour (excluding insurance premiums), you may choose to:

  • accept an alternative Tour of equivalent or higher quality (at no extra cost);

  • accept an alternative Tour of lower quality (with a refund of the price difference); or

  • cancel your Booking and receive a full refund of all monies paid, except for any insurance premiums.

If you wish to cancel for this reason, you must notify us within 7 days of the issue date printed on your final invoice.

5.6 If the cost of your Tour decreases as a result of the same factors, we will refund the difference less an administrative fee of £150. Please note that many of our suppliers operate in local currencies, and not all exchange rate movements will affect your final price.

5.7 No price changes (increases or decreases) will be made within 20 days of your departure date, and no refunds will be issued during this period.

5.8 Prices shown on our Website, in brochures, or in email correspondence are quoted per person, and may appear in British Pounds (GBP), US Dollars (USD), or Euros (EUR). Prices for the same Tour may vary by region due to differences in accommodation tier, inclusions, and marketing presentation.

5.9 The durations shown for single-destination holidays are based on the number of nights of accommodation booked, excluding travel time to and from your starting point.

5.10 We do our best to avoid single-room supplements, but where they apply, these will be clearly stated at the time of booking.

5.11 We are under no obligation to provide a detailed breakdown of individual cost components included in your Tour.

5.12 What Your Tour Price Includes
Unless stated otherwise, your Tour price includes:
5.12.1 Accommodation: In rooms with private facilities (shower and/or bath), including hotel service charges and local taxes.
5.12.2 Transportation: Ground or water-based transport between locations specified in your itinerary, such as private vehicle transfers, shared transfers, or local chartered transport.
5.12.3 Meals: As specified in your itinerary. Meals, where included, reflect local ingredients, flavours, and regional styles of cooking.
5.12.4 Sightseeing and Experiences: As detailed in your itinerary, usually with private guiding (or shared guiding where indicated, such as at certain lodges, camps, or on group tours). Entrance fees to parks and reserves are included where applicable.
5.12.5 Local Support: The services of a Company representative or appointed local partner at your destination.

5.13 What Your Tour Price Does Not Include
Unless expressly stated in your itinerary, your Tour price does not include:
5.13.1 Flights (international or domestic), visas, passports, porterage, or travel insurance.
5.13.2 Optional excursions or sightseeing not specified in your itinerary.
5.13.3 Personal expenses, including drinks, laundry, room service, telephone calls, or similar.
5.13.4 Discretionary gratuities for drivers, guides, and hotel or camp staff.
5.13.5 Any government taxes or levies introduced after the date of your Confirmation Invoice.

6. Amendments & Cancellation by You

6.1 Amendments by You

6.1.1 We will make every reasonable effort to assist if you wish to alter your Booking after your Confirmation Invoice has been issued, but it may not always be possible. Requests for amendments must be made in writing by the Lead Guest. If an amendment is possible, an administration fee of £150 per person will apply, together with any additional supplier costs incurred. This administration charge is payable whether or not we are ultimately able to confirm your requested change.

6.1.2 Some suppliers, particularly airlines, lodges, and specialist operators, may treat name or date changes as a cancellation and rebooking, in which case their full cancellation charges will apply.

6.1.3 Except for a transfer of a Booking under clause 6.2, changes within 28 days of departure may not be possible. In such cases, your request may be treated as a cancellation and rebooking, and the cancellation charges in clause 6.3.2 will apply.

6.1.4 If we are unable to accommodate your requested change and you choose not to proceed with the original Booking, this will be treated as a cancellation by you, and the cancellation charges in clause 6.3.2 will apply. Any changes made while on your Tour are your responsibility and any additional costs will be payable directly by you.

6.1.5 Date Amendments
If you wish to change the departure date of your Tour, clauses 6.1.1–6.1.4 apply. The new departure must commence within six months of the original departure date, although we will always try to offer flexibility where possible. If the rescheduled date increases the price of your Tour, the difference must be paid by you. Changes requested more than six months after the original departure will be treated as a cancellation and rebooking.

6.1.6 Group Tours
6.1.6.1 If you are booked on a Group Tour and wish to change your departure date, the alternative Tour must be of equal or greater value.
6.1.6.2 The new departure must take place within six months of the original date, subject to availability and our discretion.

6.1.7 Destination Amendments
If you wish to change the destination of your confirmed Booking, this will normally be treated as a cancellation and rebooking, and the cancellation charges in clause 6.3.2 will apply unless the change is due to Unavoidable and Extraordinary Circumstances (see clause 19).

6.2 Transfer of Your Booking

6.2.1 If you or any member of your party is prevented from travelling, that person may transfer their place on the Booking to someone else, subject to the following:
6.2.1.1 The replacement Guest is introduced by you and meets all requirements for participation in the Tour.
6.2.1.2 We are notified at least 7 days before departure.
6.2.1.3 You pay any outstanding balance, an administration fee of £150 per person transferring, and any additional supplier charges.
6.2.1.4 The transferee agrees to these Booking Conditions and all terms of the Contract.

6.2.2 You and the transferee remain jointly and severally liable for all payments. If no replacement is found, cancellation charges (see clause 6.3.2) will apply. No refunds will be issued for Guests who do not travel or for unused services.

6.3 Cancellation by You

6.3.1 Cancellations must be made in writing by the Lead Guest. A cancellation becomes effective when received by us during business hours, or the next business day if received outside these hours.

Since costs are incurred upon cancellation, the following cancellation charges apply, depending on the number of days before departure your notice is received:

6.3.2 Cancellation charges will be deducted from monies already paid. Amendment charges are non-refundable.

6.3.3 Some arrangements may be non-amendable or non-refundable once confirmed, and may incur up to a 100% cancellation charge in addition to the above.

6.3.4 During peak seasons or for certain specialist accommodations (e.g. private camps, lodges, or charters), stricter cancellation conditions may apply. You will be advised of these before booking.

6.3.5 Partial cancellations
If one or more Guests cancel, it may increase the per-person price for those still travelling. The remaining Guests are responsible for any resulting increase unless waived by the Company.

6.3.6 We strongly recommend that all Guests obtain comprehensive travel insurance covering cancellation and curtailment (see clause 12).

6.4 Cancellation Due to Unavoidable and Extraordinary Circumstances

6.4.1 You may cancel your Booking without paying cancellation charges if Unavoidable and Extraordinary Circumstances (see clause 19) occur at or near your destination and significantly affect either:
(a) The performance of the Tour, or
(b) Your ability to travel safely to the destination.

In these cases, we will refund all monies paid but will not be liable to pay additional compensation. We may refer to, though are not bound by, the advice of the UK Foreign, Commonwealth & Development Office (FCDO) in assessing such circumstances.

6.5 Cutting Your Trip Short

6.5.1 If you choose or are forced to return home early, we cannot refund the unused portion of your Tour. If you curtail your Tour without valid reason (for example, due to personal preference rather than service failure), no refund or compensation will be payable. In some cases, your travel insurance may provide cover for curtailment, and you should direct any claim to your insurer.

6.6 Re-booking Following a Cancellation

6.6.1 If you cancel your Tour and wish to rebook, this will normally be treated as a new Booking. Cancellation charges from your original Booking (see clause 6.3) will apply. If the new Booking requires a higher deposit than previously paid (after deductions), you must pay the difference before we confirm your new Booking.

6.7 Statutory Rights

This clause 6 explains your rights if you cancel your Booking. Please note that the 14-day “cooling-off” period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply to package travel contracts.

7. Amendments by the Company

7.1 We take great care to ensure the accuracy of our descriptions and prices. However, circumstances beyond our control may necessitate changes. We reserve the right to correct or update information at any time before accepting your Booking.

7.2 Itineraries may occasionally change due to local conditions or operational reasons. We reserve the right to modify programme details, sightseeing, accommodations, or other arrangements as necessary. Where such changes are significant, we will notify you as soon as reasonably possible.

7.3 After your Confirmation Invoice is issued, most changes are minor, and we will inform you as soon as possible. Minor changes include (for example): changes to accommodation of equivalent or higher standard; slight itinerary alterations; or changes to local transport schedules. We will not be liable for minor changes.

7.4 Certain health and safety measures (such as mask requirements, sanitisation, or social distancing) may apply at your destination. These are considered minor changes and do not entitle you to compensation. Guests are expected to comply with local regulations. See clause 20 for further details.

7.5 Occasionally, we may need to make a significant change to your Tour (for example, a major change of destination, accommodation to a lower standard, or substantial itinerary alteration).

7.6 If a significant change occurs before departure, you will be notified promptly and may choose to:
7.6.1 Accept the change (with a refund of any price difference, if applicable).
7.6.2 Cancel and receive a full refund.
7.6.3 Accept an alternative Tour, if available, and pay or receive any price difference.

You will be given a reasonable time (normally 7 days) to decide. If you do not respond, we will assume you accept the change.

7.7 If you cancel following a significant change, you may also be entitled to compensation (see clause 9).

7.8 If, after your Tour has commenced, a significant part cannot be provided, we will make suitable alternative arrangements. If these are of lower quality, an appropriate refund will be offered. No compensation is payable in cases of Unavoidable and Extraordinary Circumstances.

8. Cancellation by the Company

8.1 On rare occasions, we may need to cancel your Booking. This will not occur less than 75 days before departure, except in cases of:

  • Unavoidable and Extraordinary Circumstances

  • Failure to pay your balance

  • Insufficient participant numbers for a Group Tour

In such cases, we will notify you as soon as possible and offer either an alternative Tour or a full refund. If the alternative is of lower cost, the difference will be refunded.

8.2 Group Tours & Minimum Guests
Group Tours require a minimum of 4 Guests, we will notify you at least 20 days before departure if the Tour cannot proceed. In cases where a last-minute Tour is booked within 2 months of departure, this notification period may be shortened to 10 days, though we will always make every effort to inform you as soon as possible. We will still try and run the tour with less than the minimum number, but at our discretion.

You may then choose:

·       an alternative date or Tour (with any price difference applied); or

·       to receive a full refund of monies paid for the Tour.

No compensation will be payable for any additional costs (e.g., visas, travel insurance, or flights booked independently), but we will make every effort to guide you and minimise inconvenience.

8.3 Refunds will be issued in the same currency and to the same account or card used for payment.

9. Our Responsibilities for the Performance of Your Tour

9.1 The Company does not itself own or provide the services, facilities, or travel arrangements included in your Tour. These are provided by independent third-party suppliers (or occasionally other group companies, which are separate legal entities). These suppliers provide their services under their own terms and conditions, which form part of your Contract with us. Some of these may limit or exclude the supplier's liability, usually in accordance with applicable International Conventions. Copies of the relevant parts of these terms and conditions are available on request. The Company exercises reasonable skill and care in arranging these services and applies all reasonable checks to ensure suppliers maintain appropriate standards.

9.2 We accept responsibility for the Tour as an “organiser” under the Package Travel and Linked Travel Arrangements Regulations 2018 (PTRs) and are responsible for the proper provision of the travel services specifically included in your Confirmation Invoice and final itinerary. You must show that we or our supplier(s) were negligent if you wish to make a claim.

9.3 We are not responsible for any additional services not listed in your Confirmation Invoice or final itinerary.

9.4 Descriptions, information, and opinions in our brochures or on our website are given in good faith, based on the latest information available at the time of publication.

9.5 We will not be responsible or pay compensation for any injury, illness, death, loss, damage, or expense resulting from:

  • 10.5.1 The acts or omissions of the person affected;

  • 10.5.2 The acts or omissions of a third party unconnected with the services contracted;

  • 10.5.3 Unavoidable and Extraordinary Circumstances (see clause 19).

9.6 Our liability for loss or damage to luggage, personal possessions, or money is limited to the excess on your travel insurance. For other claims not involving injury, illness, or death, the maximum we may pay is up to three times the price paid for the Tour, and only if you received no benefit from the booking.

9.7 Liability for international travel and accommodation is limited as if we were a carrier under the relevant International Conventions (e.g., Montreal Convention 1999, Warsaw Convention 1929, Athens Convention 1974, Berne/COTIF 1961, Geneva Convention 1973). These conventions and the carriers’ own Conditions of Carriage form part of your Contract.

9.8 In cases covered by EC Regulation No 261/2004 (denied boarding and flight disruption), any liability we may have is limited to the remedies under EC 261, as if we were the carrier.

9.9 Any compensation we pay may be offset by any money you have received or are entitled to from carriers or accommodation providers.

9.10 If we or our suppliers negligently perform the booked services and fail to resolve your complaint in a reasonable time, affecting the enjoyment of your Tour, you may be entitled to a price reduction, compensation, or both. You must inform us without undue delay.

9.11 Claims must be notified in accordance with our complaints procedure.

9.12 Any payment made to you may require you to assign rights against third parties to us and cooperate in seeking recovery.

9.13 Operational decisions by carriers or airports (delays, diversions, rescheduling) are beyond our control. If unavoidable circumstances force changes or termination of your Tour after departure, our responsibility is limited. Adequate travel insurance is strongly recommended.

9.14 We do not accept liability for:

  • 10.14.1 Losses you could not reasonably foresee prior to booking;

  • 10.14.2 Business losses, indirect, or consequential losses;

  • 10.14.3 Services not part of your confirmed Tour, including local excursions purchased independently.

9.15 If you cannot return to your departure point due to Unavoidable and Extraordinary Circumstances, we will provide accommodation (comparable standard) for up to three nights per person, unless you are pregnant, have reduced mobility, are a minor, or need specific medical assistance, provided we were notified at least 48 hours before the Tour.

9.16 We accept no responsibility for access restrictions or other limitations imposed by destinations based on race, gender, or sexual preference. You are responsible for ensuring your destination meets your needs.

9.17 Adventure travel and Activities (e.g., excursions involving animals, water sports, climbing, flying) carry inherent risks. You assume these risks, including the risk of serious injury or death.

9.18 We do not exclude liability where it is unlawful to do so, including for death or personal injury caused by our negligence or fraud.

9.19 If you face difficulty during the Tour, we will provide appropriate assistance, including information on health services, local authorities, and alternative arrangements. Costs incurred due to issues not caused by us are your responsibility.

11. Your Responsibilities

11.1 Travel advice

  • Check travel advice from your home government, passport/visa issuing authority, and destination government. Advice may change, so review it regularly.

  • If you choose to travel despite government warnings, you assume all risks of injury, death, loss, or property damage.

11.2 Passports & visas

  • You must obtain and carry all required documents (passports, visas, health certificates, international driving licences).

  • Minors traveling without parents or with different surnames may need additional documentation proving parental consent.

  • Failure to comply may result in denied entry or other losses, and we are not liable for these. You agree to reimburse any fines or losses we incur due to non-compliance.

11.3 Flight tickets & check-in

  • You are responsible for booking, checking names/timings, and checking in for all flights.

  • Delays or missed flights due to late check-in or unavoidable circumstances are your responsibility.

  • No refunds will be given for lost, mislaid, or destroyed travel documents.

11.4 Behaviour

  • If your behaviour endangers others or property, we may terminate your Booking. No refunds will be given, and you may be liable for damage costs.

  • We are not responsible for other guests’ behaviour.

  • Lost items should be reported to local authorities.

  • You are responsible for any extra charges or damages incurred during the Tour.

12. Travel Insurance

12.1 All travellers must have appropriate travel insurance covering cancellation, medical expenses, evacuation/repatriation, personal baggage, liability, death, permanent disability, and any Activities. Proof of insurance may be requested.

12.2 If participating in independently arranged excursions (for example camel rides, 4x4 rides, camel treks), sports or dangerous activities, insurance is your responsibility. Special coverage may be required for scuba diving or similar activities.

12.3–12.4 Airlines are responsible under EC 261 for denied boarding, cancellations, or delays. Any compensation paid by us will require you to assign your rights against the airline to us.

12.5 Build reasonable arrival buffers to avoid impacting your Tour from flight delays.

12.6–12.7 Carrier identities, flight timings, aircraft type, and seat assignments may change. Changes do not entitle you to cancel other Tour components without charges.

12.8–12.9 Seat reservations are at the airline’s discretion. Airlines are independent contractors, and we are not responsible for seat assignments, name changes, or travel document issues.

12.10–12.13 Airlines may enforce smoking bans; some suppliers may require waivers; beginners may need paid lessons before using equipment. You accept these conditions.

13. Excursions

13.1 Excursions booked locally are contracts with local providers, not us. We have no liability for these.

13.2 We may provide guidance or assistance in emergencies but are not liable for costs unless caused by our negligence.

14. Illness, Disability, Pregnancy, Fitness, and Minors

14.1–14.2 Disclose any disability or medical condition before booking. Some Tours are physically demanding or have limited facilities.

14.3–14.5 Failure to disclose medical or mobility issues may result in cancellation and applicable charges.

14.6 Guests must be physically and emotionally fit. Non-self-sufficient guests should travel with a companion.

14.7 Certain physically demanding Tours may require a medical waiver form. Failure to return it may result in Booking termination.

14.8 Pregnancy

  • Inform us at booking or if pregnancy occurs afterward. We will try to accommodate, but if unable, we may amend or cancel the Booking for safety reasons.

14.9 Minors

  • Some Activities may be unsuitable for Minors. We will try to accommodate, but inability to do so may result in amended or cancelled bookings.

  • Group Tours generally exclude anyone under 14. Minors 14–17 require adult accompaniment and case-by-case assessment.

15. Complaints

  • Report issues immediately during the Tour to allow local resolution.

  • If unresolved, submit full written details within 30 days of return. Delays may affect your rights.

  • Disputes can be resolved via Alternative Dispute Resolution if necessary.

  • All descriptions, prices, and details are given in good faith, but changes may occur.

  • We will notify you of significant changes at or after booking.

17. Unavoidable and Extraordinary Circumstances

  • We are not liable for events beyond our control, including war, terrorism, pandemics, epidemics, or natural disasters.

  • Reasonable measures will be taken, but consequences may be unavoidable.

18. Unavoidable and Extraordinary Circumstances

18.1 We will not be liable or pay compensation if our obligations are affected by Unavoidable and Extraordinary Circumstances. These are situations beyond our control that could not have been avoided even with all reasonable measures, including war, acts of terrorism (or threat thereof), significant risks to human health such as pandemics or outbreaks of serious disease, or natural disasters such as floods, earthquakes, or extreme weather that make it impossible to travel safely.

19. Public Health: Communicable or Infectious Diseases

19.1 “Communicable Disease” means any illness caused by microorganisms that can spread directly or indirectly from one person to another. “Infectious Disease” means any such illness that enters the body, multiplies, and can cause infection.

19.2 You acknowledge that exposure to Communicable and Infectious Diseases, including COVID-19, carries inherent risks of illness, injury, or death, and exists wherever people gather, including on tours. Risk may also extend to others you encounter.

19.3 You voluntarily assume all risks related to exposure to these diseases. Participation in the Tour is entirely voluntary, and you should make an informed decision based on your personal risk, consulting a medical provider if needed.

19.4 You agree to comply with all public health rules, regulations, mandates, and safety protocols issued by the Company, suppliers, or Public Health Authorities, which may include testing, health screenings, isolation or quarantine, temperature checks, mask-wearing, physical distancing, or other measures.

19.5 Public health protocols may change at any time. You are responsible for confirming and following any updated measures applicable to your destination or Tour.

19.6 You are responsible for obtaining up-to-date travel advisories, warnings, and requirements from relevant authorities or embassies. If government travel warnings exist and you choose to travel regardless, you assume all risks of injury, death, or property damage.

19.7 You may be required to sign an acknowledgement of fitness to travel and compliance with health protocols.

19.8 We are not liable for any costs, losses, or refunds incurred if you cannot travel or continue your Tour due to COVID-19, including if you:

  • 20.8.1 Are diagnosed with or exposed to COVID-19 before departure and must self-isolate.

  • 20.8.2 Are diagnosed with or exposed during the Tour and must self-isolate.

  • 20.8.3 Fail any required testing or health measures, including proof of vaccination, as required by suppliers, authorities, or destinations.

19.9 Each destination may implement its own health measures. You are responsible for understanding and complying with them.

19.10 Compliance with local and national measures is mandatory; failure may result in penalties or additional costs.

19.11 We will notify you of any known mandatory measures in advance where possible, but it is your responsibility to check regularly.

20. Other Important Terms

20.1 These Booking Conditions and your Confirmation Invoice form the entire agreement between you and the Company. You are not relying on any other statement, promise, or assurance.

20.2 These Booking Conditions are between you and the Company. No other person may enforce any of their terms.

20.3 If we do not act immediately against a breach on your part, this does not waive our rights to act later.

20.4 We may transfer our rights and obligations under these Booking Conditions to another organization and will try to notify you if this happens.

21. Governing Law and Jurisdiction

22.1 These Booking Conditions and any disputes arising from them are governed by the laws of England and Wales. Any dispute, claim, or matter arising from your Booking will be dealt with by the courts of England and Wales.
